In a groundbreaking move, a federal judge has given the green light to a historic settlement that could revolutionize the way college athletes are compensated. The agreement, worth approximately $2.8 billion, would allow schools to pay their athletes directly, marking a significant shift away from the NCAA’s long-standing amateurism rules.
Under the terms of the deal, schools would be permitted to pay their athletes up to a certain limit, with the cap expected to start at around $20 million per school and increase annually. This change would enable athletes to share in the billions of dollars generated by college sports revenue.
The settlement stems from a trio of antitrust lawsuits that claimed the NCAA’s rules unfairly restricted the earning potential of college athletes. As part of the agreement, the NCAA would pay damages to former and current athletes, with estimates suggesting that around 90% of the funds would go to football and men’s basketball players.
However, some have raised concerns about the fairness of the allocation, arguing that it could violate federal Title IX laws and disproportionately benefit male athletes. Others have objected to restrictions on third-party boosters and name, image, and likeness deals, which could limit the ability of athletes to negotiate endorsement contracts.
Despite these concerns, Judge Claudia Wilken has granted preliminary approval to the settlement, paving the way for a final hearing in April 2025. Athletes impacted by the deal will have until January 31 to file objections or opt out.
The NCAA has hailed the settlement as a key step towards reshaping the economic model of college sports, allowing athletes to be paid without being considered employees. However, the organization acknowledges that further action from Congress is needed to address pending legal challenges.
As the settlement moves forward, athletes and advocates will be watching closely to ensure that the changes bring about the promised benefits and do not perpetuate existing inequalities.
